Terms and Conditions

§ 1. General provisions

1. The online store JAPANCONDOMS.COM, available at https://japancondoms.com, is operated by NOWY KROK Sp. z o.o., with its registered office at ul. Sportowa 6, apt. 59, 35-111 Rzeszów, Poland, entered into the National Court Register (KRS) under number 0001057330, share capital PLN 5,000, NIP 8133903455, REGON 526356818.

§ 2. Definitions

1. Consumer – a natural person concluding a contract not directly related to their business or professional activity.
2. Seller – NOWY KROK Sp. z o.o., with its registered office in Rzeszów, Poland.
3. Customer – any person making purchases via the Store.
4. Entrepreneur – a natural or legal person conducting business activity and using the Store.
5. Store – the online store operated by the Seller at https://japancondoms.com.
6. Distance contract – a contract concluded without the simultaneous physical presence of the parties.
7. Order – a declaration of intent submitted by the Customer aimed at concluding a Sales Agreement.
8. Account – an individual customer account in the Store.
9. Product – a movable item being the subject of the Sales Agreement.
10. Sales Agreement – an agreement concluded between the Customer and the Seller.

§ 4. Technical requirements

• a device with Internet access and a web browser;
• an active e-mail address;
• enabled cookies.

§ 5. Prices

1. Prices are given in euro (EUR); prices in other currencies are shown for reference only.
2. Product prices are shown without VAT. VAT is added in the cart according to the delivery address, and the total amount — Products and delivery — is shown before the Order is confirmed.
3. Orders delivered outside the European Union are sold without VAT as an export; customs duties and import taxes of the destination country are paid by the recipient.

§ 6. Customer Account

1. Creating an Account is voluntary and free of charge. Orders may be placed with or without an Account.
2. The Customer may delete the Account at any time.

§ 7. Placing orders

1. Placing an Order constitutes an offer to conclude a Sales Agreement.
2. The Sales Agreement is concluded upon confirmation of the Order by the Seller.

§ 8. Delivery and payment

1. Products are shipped from Poland to European Union countries and to countries outside the EU. Delivery costs are specified on the Delivery Information page and in the cart.
2. Payment is made online by card through Stripe and is charged in euro.
3. Orders are dispatched on working days after the payment has been confirmed.

§ 9. Right of withdrawal

1. The Consumer has the right to withdraw from the Sales Agreement within 14 days of receiving the Product, in accordance with the Return Policy.
2. The right of withdrawal does not apply to Products delivered in sealed packaging which, for health or hygiene reasons, cannot be returned once opened — this includes condoms and intimate lubricants whose packaging has been opened.

§ 10. Complaints

1. The Seller is liable for defects in Products in accordance with applicable law.
2. Complaints may be submitted in writing or by e-mail.
3. Complaints are examined within 14 days.

§ 11. Personal data

1. The Seller is the controller of the Customer's personal data, which are processed to perform the Sales Agreement, as described in the Privacy Policy.
2. The Customer has the rights provided for under the GDPR.

§ 12. Final provisions

1. These Terms and Conditions are governed by Polish law, without depriving the Consumer of the protection granted by the mandatory provisions of the law of their country of residence.
2. In matters not regulated herein, generally applicable provisions of law shall apply.
3. The Consumer may use out-of-court complaint and redress procedures, including those of consumer protection bodies in their country.
